The Most Recent DACA Ruling

Last week, a federal judge in Texas halted new applications for Deferred Action for Childhood Arrivals (“DACA”). This situation is fluid, and JFCS East Bay’s Immigration Legal Services program is committed to staying on top of developments. For now, here’s what the new court ruling means for DACA:

New DACA applications are “frozen.”

  • If someone has never been granted DACA status before, and tries to submit an application now, it will be held/frozen indefinitely.
  • If someone has never been granted DACA status before, and recently submitted an application that is still pending, there is now an indefinite freeze on that application.

Previous DACA grants and renewal applications remain unchanged, for now.

  • If someone has DACA now, their status is still good.
  • If someone applied to renew DACA after a previous grant, that renewal application will be processed.
  • If someone needs to file a DACA renewal application, they can still do so, and JFCS East Bay is here to help: call us at (925) 927-2000 for an appointment.
  • It’s important for people to not to fall out of status. Current DACA holders should be sure to file their renewal applications before their status expires!

JFCS East Bay is here to support our community! We continue to serve our clients’ DACA-related needs by:

  • Filing applications to renew previous DACA grants.
  • Providing legal consultations about potential DACA eligibility.
  • Tracking potential DACA applicants for future follow-up.

If you or someone you know has questions about DACA status or eligibility, please call JFCS East Bay at (925) 927-2000 to sign up for a legal consultation in Spanish or English.

Together with our network of immigration legal services partners in Alameda and Contra Costa counties, JFCS East Bay joins the chorus of voices calling on Congress to permanently protect Dreamers by granting them a path to citizenship.

As we uphold our core value of inclusion, we break down barriers to access for all. No human is illegal and all immigrants deserve legal access and protection.
